Balogun, NCAA working it out

Oklahoma linebacker Mike Balogun has a hearing set before a Cleveland County judge Monday afternoon, but it might not be needed.

Balogun’s attorney, Woody Glass, told the Fort Worth Star-Telegram Saturday that a compromise with the NCAA regarding Balogun’s eligibility could be reached outside of the courtroom.

“We are working on resolving the situation in a way that will be a case of win-win for everyone,” Glass told the newspaper.

Two messages left for Glass by the Transcript Saturday were not returned. As of Saturday, Balogun’s hearing is still on the Cleveland County civil court docket.

Balogun received an injunction Tuesday in a lawsuit against the NCAA that prevented the organization from executing a de-certification declaration, pending outcome of its investigation. The order has allowed Balogun to continue to practice with the team.

At issue is whether Balogun, 25, played semi-pro football in the North American Football League after his 21st birthday.

Balogun and the former owner of the Maryland Marauders, the team Balogun played for in 2003 and 2004, have both signed affidavits saying he didn’t. The league’s former commissioner has also stated that he can find no evidence that he did.

However, there are game recaps from 2005 on the league’s Web site that show Balogun playing in games that season.

A former assistant coach of the Maryland Marauders has also told the NCAA he believes Balogun played in 2005, but has not done so in a sworn affidavit.

NCAA rules state that if a player participates in an organized league past the age of 21, he would lose a year of eligibility for every year he competed. Balogun is a senior this season.
